Terms Of Use – Users

1 Introduction

• Please read these Terms and Conditions (“Terms”) carefully. By accessing or using the Pickup platform (“Platform”) through our applications (“Application”) or websites to receive services made available by Pickup, you hereby agree that
  (i) you have read and understood these Terms;
  (ii) you will comply with these Terms;
  (iii) you are at least 18 years old and legally competent to enter into contracts;
  (iv) you have the right and authority to enter into these Terms, including on behalf of any organization you represent; and
  (v) these Terms set forth the legal obligations between you and Pickup. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE PLATFORM.
• Pickup reserves the right to modify these Terms at any time, with changes becoming effective upon posting. Continued use of the Platform after modifications shall constitute acceptance of the revised Terms. It is your responsibility to review them regularly.
• Pickup facilitates connections between users and independent third-party delivery partners. Pickup does not own, employ, or directly provide transportation or logistic services.

2. Your Account

• You must register a personal account (“Account”) to use the Services. You agree to provide accurate information and update it as necessary. Pickup is not responsible for false, incomplete, or outdated information provided by you.
• You are responsible for maintaining the security of your Account. Unauthorized access or security breaches should be reported immediately.
• Pickup does not guarantee that the Services will function on any specific hardware or device. You are responsible for maintaining compatible devices.
• The Services may be restricted based on jurisdictional regulations. Users must comply with applicable laws.

3. General Representations and Warranties

By using the Services, you represent and warrant that:

• You may only register one Account, and Pickup may deactivate duplicate accounts.
• You will access the Services only through authorized means.
• You are the sole authorized user of your Account.
• Transfer of your Account is not permitted.
• You will comply with all applicable laws.
• The Services will not be used for unlawful purposes.
• You will not discriminate against or harass others.
• You will not infringe on third-party rights.
• You will not collect or harvest personal information.
• You may be required to provide identity verification documents.
• Pickup reserves the right to include/exclude users from promotions.
• You will not engage delivery partners outside of the Platform.

4. Use of Services

• Pickup reserves the right to modify, suspend, or terminate accounts or services at its discretion.
• Users acknowledge that third-party delivery partners provide the services, and Pickup is not responsible for transportation or delivery quality.
• Users must ensure shipments comply with applicable laws and are securely packaged.
• Users assume responsibility for verifying delivery partner information before engaging in transactions.

5. Payments

• Users must pay the full service charge. Pickup may revise pricing at any time.
• Payments are non-refundable unless otherwise stated.
• Users must adhere to payment methods supported by Pickup.
• Pickup is not responsible for payment processing errors caused by third-party payment providers.

6. Communication

• By using the Platform, users consent to receive communications via email, SMS, or notifications.
• Users may opt-out of non-essential communications but may still receive important service notifications.

7. Intellectual Property

• Pickup owns all intellectual property rights related to the Platform.
• Users may not copy, modify, or distribute Platform content without authorization.
• By providing feedback, users grant Pickup the right to use it without compensation.

8. Third-Party Interactions

• Pickup is not responsible for third-party interactions through the Platform.
• Users engaging with third-party service providers do so at their own risk.

9. Promotions and Loyalty Programs

• Pickup may offer promotions at its discretion.
• Promotions cannot be duplicated, sold, or transferred.
• Pickup reserves the right to modify or cancel promotions at any time.

10. Disclaimers

• The Platform and Services are provided “as is.” Pickup makes no guarantees regarding service reliability, availability, or quality.
• Users assume all risks associated with using the Services.
• Pickup does not control third-party service providers and is not liable for their actions.

11. Limitation of Liability

• Pickup is not liable for damages arising from service use, including lost shipments or financial losses.
• Users are responsible for insuring high-value shipments.
• Pickup’s liability is limited to a maximum of three times the service fee or INR 10,000, whichever is lower.

12. Indemnification

• Users agree to indemnify Pickup against claims, damages, or liabilities arising from their use of the Platform.

13. Confidentiality

• Users must maintain the confidentiality of Pickup’s business information.
• Pickup is not responsible for confidential information disclosed by users.

14. Assignment

• Users may not transfer rights under these Terms, but Pickup may assign its rights without restriction.

15. Severability

• If any provision is deemed unenforceable, the remaining terms remain in effect.

16. Governing Law & Dispute Resolution

• These Terms are governed by Indian law. Disputes will be resolved through arbitration.

17. Language

• The English version of these Terms prevails in case of discrepancies with other translations.
