Terms Of Use – Driver Partners

1. Introduction

1.1 These Pickup Delivery Partner Terms of Use (“Terms”) govern your access or use of the Pickup platform (“Platform”) via our mobile and website applications (together, “Applications”) to receive services provided by Pickup. By accessing or using the Platform, you confirm that:
(i) You have read and understand these Terms;
(ii) You will comply with these Terms;
(iii) You are at least 18 years old and legally competent to enter into contracts;
(iv) You have the authority to enter into these Terms on behalf of any organization you represent; and
(v) These Terms constitute a legally binding agreement between you and Pickup.

1.2 Pickup reserves the right to modify these Terms at any time, effective upon posting. Your continued use of the Platform constitutes your acceptance of such modifications.

2. Partner Account

2.1 To use the services, you must register for a Pickup Partner account (“Partner Account”). Upon successful registration, you will receive account credentials.

2.2 You must provide accurate and complete personal information during registration. Pickup is not liable for any consequences arising from incorrect or outdated registration details.

2.3 You are responsible for securing your account credentials and for all activities under your account. Pickup reserves the right to verify your information at any time and restrict your account if necessary.

2.4 Usage guidelines:

  • You must access the services only through authorized means.
  • The Platform must be used for personal service only and not resold.
  • Account transfer or multiple account creation is prohibited.
  • You must comply with applicable laws and refrain from unlawful activities.
  • Unauthorized data collection, deep-linking, or interference with system security is strictly prohibited.

3. Description of Services

3.1 Pickup provides an information-matching service to connect demanders of transportation/logistics services (“Users”) with partners who provide such services (“Delivery Partners”). Pickup itself does not provide transportation services.

3.2 Your relationship with Pickup is independent, and there is no employment or agency relationship. Using Pickup-branded items does not indicate employment status.

4. Representations, Warranties, and Obligations

4.1 You acknowledge and agree that:

  • You are responsible for verifying user information before accepting a delivery request.
  • You must hold valid licenses and permits for performing delivery services.
  • You are responsible for loss, theft, or damage to shipments.
  • You must comply with all legal requirements, including vehicle and insurance regulations.
  • You will maintain the confidentiality of user information.

4.2 Failure to comply with these obligations may result in account suspension or termination.

5. Software Usage

5.1 You agree that:

  • You will not rent, sublicense, or transfer copies of the Pickup software.
  • You will not attempt to modify or reverse-engineer the software.
  • You will not introduce viruses or interfere with the platform’s security.

6. Payments

6.1 Users are responsible for payment of services. Pickup facilitates transactions but does not process direct payments.

6.2 You may receive payments through Pickup’s wallet system, with periodic payouts. Negative wallet balances may restrict service access.

6.3 Pickup charges a service fee/commission for facilitating service connections. Fee structures may change over time.

6.4 Taxes, including TDS, will be deducted where applicable. You must provide necessary tax documentation.

6.5 Security deposits may be required and are refundable under applicable policies.

7. Indemnification

7.1 You agree to indemnify Pickup against all losses, claims, and liabilities arising from:

  • Your breach of these Terms.
  • Any loss or damage caused to users or shipments.
  • Failure to hold necessary permits and insurance.
  • Any violation of applicable laws.

8. Disclaimers

8.1 Pickup provides the Platform “as is” and does not guarantee uninterrupted or error-free service.

8.2 Pickup does not control third-party service providers and is not liable for their actions.

9. Intellectual Property

9.1 Pickup owns all rights to the Platform and its intellectual property.

9.2 By providing content to Pickup, you grant Pickup a worldwide, royalty-free license to use that content.

10. Miscellaneous

10.1 These Terms are governed by Indian law. Disputes may be settled through mediation, arbitration, or courts at Pickup’s discretion.

10.2 Pickup may modify or terminate services at any time.

10.3 Communication from Pickup may include emails, SMS, and push notifications. Opting out may impact your service access.

By continuing to use the Pickup platform, you agree to abide by these Terms.
